Terms and Conditions Of Services And Supply

Summary:

We Clean Carpets Limited (“We Clean”) reserves the right to change or amend these terms at any time. By ordering any services and/or goods from We Clean by any means, electronic or otherwise, the Customer agrees to be bound by these terms and conditions. It is the Customer’s responsibility to notify We Clean prior to any goods being supplied or services being commenced of any issue that may affect these terms and conditions or the Customer’s understanding of the service or goods being provided. Once goods have been supplied or services commenced it is accepted that the Customer has read and agrees to these terms and conditions and has accepted the quotation provided by We Clean. Where the Customer consists of two or more persons their obligations and/or liability to We Clean shall be joint and several. While We Clean will use reasonable care and skill to perform the Services, there is no guarantee that We Clean will be able to remove any stains present due to factors including (without limitation) the surface, the substance that caused the stain, how long it has set for and other environmental factors. 

Quotations:

Any quotations provided by We Clean is valid in writing only and for a period of 30 days from the date provided. All quotations are exclusive of Goods and Services Tax unless specifically agreed to in writing. The Customer shall pay GST to We Clean in respect of goods and services provided at the earlier of the date of Invoice or the time of supply. The Customer agrees to pay for those additional goods or services provided by We Clean in addition to any quotation. 

Change in Scope:

If any aspect of the scope of work changes then the quotation provided by We Clean will be deemed to be immediately withdrawn and We Clean will provide a new quotation to the Customer. 

Customer’s Goods:

It is the Customer’s responsibility to secure all goods, electronic equipment and fragile items prior to any service being commenced. We Clean does not move heavy items and any heavy item that is required to be moved is the Customer’s responsibility to do so. In such situations these heavy items will be cleaned around. We Clean accepts no responsibility or liability whatsoever in respect of goods, electronic equipment or fragile items that may be required to be moved including (without any limitation) any damage to them.

Fading, Stains, Shrinkage (Fabrics and Carpets):

We Clean shall not be liable for colour loss, deteriorated fabrics, splitting, fraying or loose worn fibres. We Clean takes reasonable care and skill with their Customer’s goods and uses professionally accepted products during their services. We Clean accepts no liability for damage, movement, shrinkage, stretching, loose or lifted edgings which could result from any number of causes. In addition to this some stains may reveal themselves once cleaning has taken place or may not be able to be removed without the use of chemicals which in some cases may cause fading and We Clean is not liable in these circumstances as long as reasonable care and skill is used by We Clean. We Clean accept no responsibility for any third party (including pets) that may be at or enter the premises and resoil already serviced areas. Fabrics may have been subject to strong light or heavy soiling which may not be apparent until the cleaning is completed for which We Clean is not responsible.

Products Supplied:

Any product provided to the Customer is to be applied according to the manufacturer’s specification. We Clean supply these products at the request of the Customer and do not endorse the products. Any complaint about these products must be made to the manufacturer.

Cancellation:

The Customer may cancel and reschedule a service by providing 24 hours’ notice to We Clean. Should the cancellation time provided be less than 24 hours notice a cancellation fee of $95.00 plus GST becomes immediately due and payable by the Customer. After cancellation should the Customer not reschedule the service We Clean reserve the right to charge up to 50% of the agreed amount quoted for that service. Should the Customer wish to cancel a term contract, the Customer may do so but only after paying We Clean an amount equal to 25% of We Clean’s charges for the remainder of the term of the contract.

Lighting, Power & Water Services:

The Customer is solely responsible for providing (at its sole cost) all necessary utilities to We Clean including (but not limited to) on-site lighting, power and water as required. We Clean shall not be responsible for incomplete workmanship due to either lighting, power or water not being fully and freely available. Should sufficient lighting, power and water not be available and the services cannot be carried out a cancellation fee of 25% of the contract rate or $95.00 plus GST (whichever is the greater) shall be immediately payable by the Customer to We Clean and We Clean may either (at its sole election) have the job rescheduled or cancel the job without any liability to the Customer.

Access to Work Site/Safety:

The Customer shall ensure that access to the required work site enables We Clean to carry out the required service or supply of goods. Should reasonable access not be available and the services cannot be carried out a cancellation fee of 25% of the contract rate or $95.00 plus GST (whichever is the greater) shall apply and the job rescheduled or We Clean can cancel the job without any liability to the Customer. The Customer shall be solely responsible for ensuring that the premises are safe for We Clean employees, servants and agents. 

Equipment – Insurance:

We Clean provides a range of equipment that may remain on the Customer’s site. It is the Customer’s responsibility to secure the equipment on site and ensure it is not at risk. The Customer shall be liable for any damage or loss of equipment (including, without limitation, loss by theft) and by agreeing to these terms and conditions accept and acknowledge that they carry the required insurances to cover any loss or damage.

Consumer Guarantee Act 1993:

The Customer acknowledges where the services of We Clean are being supplied for trade or business purposes, the provisions under the Consumers Guarantees Act 1993 (“Act”) shall not apply. However if the Customer is a Consumer (as defined in the Act), then the provisions of the Act apply. 

Payment:

Payment for goods and/or services is immediately due upon completion of the services requested by the Customer or as otherwise agreed by We Clean. Payment shall be made immediately in cleared funds free of any deduction or withholding whatsoever (whether by set-off, counterclaim or otherwise). The Customer will pay interest at the default rate of 1.5% per month (calculated on a daily basis) on any amounts unpaid to We Clean from the due date of payment until the date of payment and despite any intervening judgement. Should We Clean incur any additional charges in connection with obtaining payment of overdue monies owing by the Customer (including debt collection and legal fees), the Customer shall also be liable to We Clean for those charges. 

Claims and Acceptance:

Any complaint or claim against We Clean must be made within 48 hours of the services being completed otherwise the Customer is deemed to have accepted the services and waived its rights to bring a claim against We Clean. If the Customer notifies We Clean within the 48 hour period, the Customer must allow We Clean on to the site within 18 hours of the notification to endeavour to rectify any concerns the Customer may have. If the Customer does not provide that access then the Customer is deemed to have accepted the Services and waived any and all claims against We Clean. 

Privacy:

I/We authorise any person or owner to provide you with such information as you may require in response to your credit inquiries. I/We authorise you to furnish to any third party details of this application and any subsequent dealings that I/We may have with you as a result of this application being actioned by you. 

Limitation :

Should, despite any of the exclusions above, We Clean be liable to the Customer then the maximum aggregate liability of We Clean to the Customer shall be limited in aggregate to the lesser of $750 or the sum actually paid by the Customer to We Clean for the Services in respect of which the liability arises.
